If not invoked, there is no requirement -by the U.S.- to contact their Consular before prosecution. Needless to say the process is not as simple as it sounds, I'll leave the details to lawyers; the concept is all we need here. BTW: Since the U.S. is has ratified this Convention, it allows the U.S. to prosecute it's citizens back in the U.S. for crimes committed in foreign countries. i.e. foreign sex trafficking crimes we often hear about in the news.
